Terms of Use

Who you are agreeing with
Echoed is operated by Mathieu Bergevin, an individual based in Quebec, Canada.

Throughout this document, "we" and "us" mean Mathieu Bergevin operating Echoed, and "you" means the person using the app.
Eligibility
You must be at least 16 years old to use Echoed. If you are under the age of majority where you live, you may only use Echoed with the consent of a parent or guardian.
Your account
You need an account to use Echoed. You agree to give an accurate email address, keep your password confidential, and take responsibility for everything that happens under your account.
Tell us at hello@echoed.app if you believe someone else has accessed your account.
Subscription, trial, and billing
Echoed requires a paid subscription. There is no free tier.
Free trial. New subscribers get a 7-day free trial. The trial begins when you select a plan. You will not be charged during the trial, and you can cancel any time before it ends at no cost.
Pricing. After the trial, Echoed is $5.99 USD per month or $39.99 USD per year. Prices shown in the app are in your local currency and are the ones that apply.
Automatic renewal. Subscriptions renew automatically at the end of each period unless cancelled at least 24 hours before the period ends. Your Apple Account is charged for renewal within 24 hours of the end of the current period.
Cancelling. Cancel through Apple, not through Echoed: on your iPhone, open Settings > Apple Account > Subscriptions, then Echoed, then Cancel Subscription. You keep access until the end of the period you have already paid for. Deleting your Echoed account does not cancel your subscription.
Refunds. All purchases are processed by Apple and all refunds are handled by Apple under their terms. We cannot issue refunds. Request one at reportaproblem.apple.com.
Price changes. If prices change, existing subscribers will be notified before the change takes effect and given the opportunity to cancel. Price changes never apply retroactively to a period already paid for.
Your content
Your entries belong to you. We claim no ownership of anything you write in Echoed.
You grant us only the narrow permission needed to run the service: to store your entries, transmit them between your iPhones, and display them back to you. That permission ends when you delete the content or your account.
We do not use your entries to train artificial intelligence models. We do not sell them, publish them, or share them with anyone. See the Privacy Policy for the full detail.
You are responsible for your own content. Echoed does not review what you write.
Acceptable use
Do not use Echoed to:
- Break the law, or store content that is illegal to possess
- Access another person's account, or attempt to
- Interfere with, overload, or attempt to breach the service or its infrastructure
- Reverse engineer, decompile, or attempt to extract the source code of the app
- Resell, sublicense, or redistribute access to Echoed
- Use automated systems to create accounts or generate activity at a scale that burdens the service
Accounts that violate these terms may be suspended or terminated.
What Echoed is not
Echoed is not a therapist, and it is not a medical or mental health service. It is a journal. Nothing in the app is professional advice of any kind. If you are struggling, please speak with a qualified professional or a crisis line in your area.
Echoed is not a backup service. We take reasonable measures to keep your data safe and we sync it across your iPhones, but you should not treat Echoed as the only copy of anything you cannot afford to lose. Export is available in the app and you are encouraged to use it.
Availability and changes to the app
Echoed is provided as it is, and as it becomes available. Features may be added, changed, or removed over time. We may need to interrupt the service for maintenance, updates, or reasons outside our control.
If a change substantially reduces what your subscription provides, you will be notified and may cancel.
Deleting your account
You can delete your account at any time in the app under You, then Settings, then Delete Account.
Deletion is permanent and immediate. Your entries cannot be recovered. Export anything you want to keep first.
We may suspend or terminate an account that violates these terms, or where required by law. Where reasonably possible, you will be given notice and an opportunity to export your data.
Disclaimers
To the fullest extent permitted by law, Echoed is provided without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the service will be uninterrupted, error free, or that data loss will never occur.
Some jurisdictions do not allow the exclusion of certain warranties, including Quebec. Where that is the case, the exclusions above apply only to the extent permitted, and nothing in these terms limits any right you have under applicable consumer protection law.
Limitation of liability
To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to Echoed is limited to the amount you paid us in the twelve months preceding the claim.
We are not liable for indirect, incidental, special, or consequential damages, including lost data or lost profits.
Again, where local law does not permit these limits, they apply only as far as the law allows.
Apple
These terms are between you and us, not with Apple. Apple is not responsible for Echoed or its content, and has no obligation to provide support for it. Apple is a third-party beneficiary of these terms and may enforce them against you.
If Echoed fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. Apple has no other warranty obligation with respect to Echoed.
Changes to these terms
We may update these terms. If a change materially affects your rights, you will be notified by email and in the app before it takes effect. Continuing to use Echoed after that means you accept the updated terms.
Governing law
These terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable in it. Any dispute will be brought before the courts of the judicial district of Montreal.
If you are a consumer resident elsewhere, nothing here removes your right to bring a claim in your own jurisdiction where local law gives you that right.
